Employment Contracts

Contracts have become an integral part of agreements being made between parties nowadays. And among the scores of contracts being entered into, employment contracts are one of the widely known ones. An employment contract is referred to as an agreement being made between the employer and the employee. Usually made at the commencement of the period of employment, an employment contract stipulates the terms and conditions that are relevant to the given job and agreed to by both the parties.

Some of the important features that are usually associated with an employment contract are as such: An employment contract is a contract made between the employer and the employee. The contract envisages a set of written conditions that are both accepted by and to be followed by both the parties. An employment contract usually contains a timeframe and compensation to be allowed in case of non adherence to it by either of the parties.An employment contract can even have provisions for moving over to a court of law in case of the non conformation to the contract.In contemporary times with issues of patent, copyrights and business espionage being in the limelight, some employers even have contractual clauses of non disclosure and non compete clauses aimed at protecting their trade secrets from the competitors. There are employment contracts which form part of the broader labor and social welfare laws of the land and hence contracts are framed accordingly.

Another new feature that can be associated with the employment contract relates to its usage in the context of immigration and workforce of the foreign countries. Countries of the Middle East for instance like Saudi Arabia, United Arab Emirates, Bahrain, Kuwait depend to a considerable extent upon the supply of workforce from foreign countries. And their requirement varies from people for blue collar jobs to that of white collar jobs as well. Beyond them, even the developed countries of the US, Canada and Europe and Oceania, are in the need for workforce especially in the spheres of technical, medical and teaching professions.

In the context of global issues of immigration and labor laws besides the most talked issue of terrorism, an employment contract has assumed a very important role and significance. The employment contract nowadays are being designed by companies with the help of immigration and legal professionals who help them devise the contract in such a way that does not let create complex situations arise. The employment contract of today’s are specially designed with an eye to ensure that the employer gets the best of the available talent at a competitive compensation package. The employee to gets the best of the possible packages in term of salary, perks and perquisites while in the context of an immigrant employee, s/he also pays for the taxes of the land as applicable. Further, the employee does not get to misuse the stay in a foreign country while is made to leave the host country once the said period of employment is over and not extended or renewed.
